PRIVACY POLICY

ATTENTION: Please read this Privacy Policy (these “Terms”) carefully before using The Wumblers (“Wumblers”) Web site (the “Site”).  By going beyond the Site’s homepage, you (hereinafter “You” or “User”) are deemed to have agreed to and accepted these Terms.   If You do not accept these Terms, do not use the Site.  This Privacy Policy was last updated on August 24, 2007.

1.  Scope. This Privacy Policy only applies to information Giddy Gander collects online and not information collected offline.  This privacy policy only covers the Site. Any other websites which may be linked to by the Site are subject to their own policy, which may differ from Giddy Gander’s.

2.  Child Users. Giddy Gander is fully committed to complying with the U.S. Children's Online Privacy Protection Act of 1998.  The Site is designed to be fun and interactive and some of the online activities require parents/guardians to assist children Users to participate. Parent Users shall discuss with their child Users use of the Internet generally as well as this policy so they better understand how to use the Site and the information Giddy Gander may request.  Users under 14 years of age shall ask a parent or guardian before giving any information on the Internet (like name, email address, home address, and phone number).

3.  Collected Personal Information. Giddy Gander will not collect more personal information than is reasonably necessary to provide Users with requested services and up-to-date efficient, and reliable service.  The personal information Giddy Gander collects via the Site may include:

  1. Any personal details User knowingly provides Giddy Gander through forms, opt-in newsletters, and via email, such as name, address, email address, telephone number, date of birth etc. This includes personal information a User provides Giddy Gander (ie. name and email address).  In particular, the Site may collect an email address and name from a child User for the purpose of responding directly to a specific online request from the child. As soon as the response is sent to the child, all information collected from such request will be deleted.
  2. IP Address.  This is a string of numbers unique to a User’s computer that is recorded by Giddy Gander’s web server when a User requests any page or component on the Website. This information is used to monitor a User’s usage of the website.
  3. Data recorded by the website which allows Giddy Gander to recognize a User and his/her preferred settings. Such data is recorded locally on a User’s computer through the use of cookies. Most browsers can be programmed to reject, or warn a User before, downloading cookies.  In order to improve service Giddy Gander may use a device known as a 'cookie'. Cookies are a means by which information relating to Users’ Internet activity (such as whether a User has visited the Site before) is recorded and used to improve the website and the products and services.  Users desiring to restrict or block cookies may do so according to their web browser settings.  

Giddy Gander may also collect information that is not personally identifiable, like a User’s first name, home town or the browser used.

4.  Transferring Personal Information to Other Parties.  Giddy Gander may pass the personal information it collects to other entities solely for administrative purposes, such as processing and sorting data, monitoring how Users use the website, and issuing e-mails. These third parties will be required to maintain the confidentiality and security of Users’ personal information and will not be allowed to use it for any purposes other than to provide the administrative services requested by Giddy Gander.  Users agree that Giddy Gander may transfer Users’ personal information to any person or company that acquires all or substantially all of the shares or assets of Giddy Gander.  Giddy Gander will not transfer Users’ personal information to any other party without the User’s written consent (or the consent of the User’s parents if the User is under 18 years old), unless required by law or court order or requested by a law enforcement agency.  As Giddy Gander operates globally, it may be necessary to transfer Users’ information internationally; in such a case, Users assume the risks inherent in lower security standards potentially applicable to transferee entities.

5.  Obtaining a Copy of, Amending or Deleting your Personal Information.  A User is entitled at any time to see what personal information Giddy Gander may be storing about that User or that User’s children, and to request that such information be corrected if inaccurate, or deleted from Giddy Gander’s records.  For a copy of this information, or to request a modification or deletion, Users should send Giddy Gander a signed request in writing by mail or fax at the address listed below.

6.  Security; Disclaimers and Limitation of Liability.  All information Giddy Gander collects will be kept securely in accordance with Giddy Gander’s internal security policy. However, due to the nature of the Internet it is not possible to guarantee absolute security for the collected personal information.  User understands the inherent risks associated with operating a Web site, and that Giddy Gander would not be able to make the Site offered to User if Giddy Gander would be liable for inherent risks such as inherent security risks.  Accordingly, User expressly understands and agrees that Giddy Gander makes no warranties of any kind, whether express or implied, regarding the security of collected information.  Further, User expressly understands and agrees that Giddy Gander and its affiliates, officers, directors, shareholders, attorneys, agents, and employees shall not be liable for any damages resulting from such inherent security risks.  User further agrees to indemnify and hold Giddy Gander and its affiliates, officers, directors, shareholders, attorneys, agents, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of such inherent security risks.

7.  Modification. Giddy Gander may, at any time without notice, and in our sole discretion, amend or modify the Site or these Terms by updating the Site or this Web page. Therefore, User should review the Site and this page from time to time so that User will be aware of any such modifications.  Giddy Gander is under no obligation to update the Site or the Terms. User’s continued use of the Site after any modification to the Site will be considered acceptance of those modifications.

8. Entire Agreement; Governing Law; Severability. These Terms constitutes the entire agreement between Giddy Gander and User with respect to the privacy of User’s information collected by Giddy Gander. These Terms are entered into in the State of New Jersey and shall be governed by and construed in accordance with the laws of the State of New Jersey, exclusive of its choice of law rules.  Each party to these Terms submits to the exclusive jurisdiction of the state and federal courts sitting in the County of Essex in the State of New Jersey, and waives any jurisdictional, venue, or forum non conveniens objections to such courts.  In the event that any of the provisions of these Terms are held by a court or other tribunal of competent jurisdiction to be unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
